This Rental Agreement and Liability Waiver is entered into between the above client (Renter) and Rent IT Luz. The undersigned Renter agrees to the following conditions and terms of the Rental Agreement and Liability Waiver:

1. OWNERSHIP. All rental items are the property of Rent IT Luz.  Full right, title and ownership of the equipment will be retained at all times with Rent IT Luz.
2. RESERVATION AND PAYMENT OF RENTAL FEES.
a) Rent IT Luz has a minimum order of 25 euros excluding delivery fee.
b) Delivery fee will be notified at the time of reservation.
c) A credit card will be required to secure your reservation.  Rent IT Luz will confirm your reservation by email within 48 hours of the reservation being made.
d) You agree to pay Rent IT Luz a refundable security deposit of 50% of the total rental value which will virtually be held on your card.  We have authorisation to charge your credit card for the total replacement value or cost of any damaged or soiled equipment.  This includes any items that are stolen or not returned to Rent IT Luz.
e) Payment for the full amount of the rental fee and delivery is due 30 days before delivery.  This is in addition to the 50% security deposit that we hold.
3. INSPECTION. Renter has examined the rental items and found all items to be in good condition at the time of delivery, and agrees to return all items in the same condition as received (normal use expected). If not present at the time of delivery any issues must be reported immediately on arrival.
4. CANCELLATION POLICY.  If you wish to cancel or amend your hire agreement, you are entitled to do so and the following refund guidelines apply:
Cancellation more than 14 days prior to delivery: 100% refund
Cancellation 7 – 14 days prior to delivery: 50% refund
Cancellation within 7 days prior to delivery: 0% refund
5. RENTAL PERIOD. Renter agrees to have the item(s) in good condition, ready for pick-up at the agreed date, time, and location.  Renter is responsible for requesting any changes or extensions to the rental period by phone or email as soon as possible. Authorisation for any changes to the rental period requested by Renter may be made verbally or in writing by Rent IT Luz.  Any extension of the agreed rental period may result in additional charges to Renter.  If the early return of rental items is requested, no credit will be given for unused days.  Late returns are subject to a one-day rental charge on each item for each day or portion of a day that the equipment is returned after the specified return date.
6. USE OF EQUIPMENT. Rent IT Luz will provide applicable instruction manual(s) to Renter.  In addition, Rent IT Luz will offer to demonstrate the set up and use of equipment when delivered.  Renter is responsible for reading and following instructions and warnings for the safe and proper use of the equipment.  Renter agrees to use all item(s) as intended by the manufacturer, comply with manufacturer’s instructions, and not exceed weight or other limits established by the manufacturer.  You acknowledge that Rent IT Luz is not responsible for your failure to abide by the instructions in the given manuals.
7. ASSEMBLY & INSTALLATION.
a) Cots – Rent IT Luz will assemble full size cots at delivery.  Renter agrees not to disassemble and move cots from its original location, which may cause damage.
b) Safety Gates – Pressure mounted safety gates are NOT to be used at the top of stairs and are to be erected & checked for sturdiness by the Renter.
c) Car Seats – Rent IT Luz will not install car seats.  Installation instructions will be supplied.  Proper installation videos are also provided at the relevant manufacturer’s website.  Renter agrees to notify Rent IT Luz within 24 hours of any incident or accident involving a rented car seat.
8. DAMAGES.  In addition to charges incurred for the rental period, Renter will be charged for all costs associated with the repair, replacement, or cleaning of item(s) that are returned damaged, missing parts (including instruction manuals), or are returned in exceptionally dirty/stained condition.  In the event any item(s) are returned in a condition that renders the item(s) unsuitable to be rented (at the sole discretion of Rent IT Luz), Renter will be obligated to purchase the item(s) and will be charged for the replacement cost of the item(s) plus any related shipping charges, in addition to charges incurred for the rental period.
Cleaning charges: A cleaning charge (minimum €10 euros per item) will be assessed and charged to your credit card for any item returned excessively soiled and requiring professional cleaning services.  Excessive soiling may include chewing gum, vomit, faeces, stickers, crayon, markers or other difficult to remove substances.
9. LOST OR STOLEN ITEMS. Any item(s) not returned by Renter for any reason at the end of the above-stated or authorised pick-up time will be charged to Renter at the replacement cost of the item(s) in addition to charges incurred for the rental period.
10. WAIVER OF LIABILITY and INDEMNITY
Waiver of Liability: By accepting and using the equipment on behalf of yourself and all others that may use the equipment, you acknowledge the equipment is being used at your own risk. You agree to relieve Rent IT Luz of all liability for loss, damage, or injury associated with the use of the rental equipment, form any cause whatsoever, including negligence.
Rent IT Luz will not be responsible for accidents or injuries caused directly or indirectly by the use or misuse of our rental equipment.  By signing or accepting this agreement, you agree to accept full responsibility for using the rental equipment.
Indemnity: You agree to defend, fully indemnify and hold harmless Rent IT Luz from and against any and all claims, demands, suits, actions, causes of action and/or liability, of any kind whatsoever, for damages, losses, costs and/or expenses (including legal fees and disbursements) arising in connection with this Agreement, including without limitation: (i) any and all breaches by you of any terms or conditions of this Agreement; (ii) damages to persons or property, personal injury or death caused by negligent or wilful acts or omissions arising in connection with this agreement.
